Agreement with the user:
Before you become a customer and client of Ace Qbank’s products, you must read, approve, and accept all of the terms and conditions specified in this agreement.
We may, at any time, amend this agreement by posting the amended terms on our website https:/www. Ace Qbank.com (hereafter referred to as the “site”). All amended terms shall take effect 30 days after they are initially posted on our website, except as stated below. There will also be upcoming changes posted on this page of the website.
“Your” or “you” means any person or entity that subscribes to and/or uses the service (“users”) in this Agreement. Unless otherwise mentioned, Ace Qbank will be collectively referred to by “us,” “we,” or “our.”

AGREEING TO THE TERMS OF USE INCLUDES THE FOLLOWING:
License:
In consideration of and subject to your payment of the appropriate subscription fee for the services you subscribe to, and your agreement to and compliance with the terms and conditions set forth in this agreement, Ace Qbank grants to you a non-exclusive, non-sub licensable, non-transferable license, and right to use and access the Ace Qbank content (the “licensed materials”) from multiple devices/locations with non-concurrent login access (“different times”). You are not allowed to access the Ace Qbank content from various devices/locations concurrently (at the “same time”). Simultaneously, access from multiple devices/locations to Ace Qbank services will be identified as to account sharing, and appropriate action as specified in this agreement’s ‘ Restriction of transfers ‘ section will be taken.
Software Use Terms:
Ace Qbank Software is intended to be running with the Java Runtime Engine (JRE) 8.0 or later on Windows and Macintosh and is used for question banks (Qbank), self-assessment, and clinical decision making (CDM).
Any attempt to use the Ace Qbank software with lower versions of JRE constitutes a violation of the terms and conditions set forth in this agreement and might result in unexpected behavior, for which Ace Qbank cannot be held responsible or liable for any damages. The Ace Qbank software is designed to access your computer system’s clipboard during use.
While the test is up and running, all clipboard functions of your computer (including copy-print and save-to-disk functions, not limited to) will be discarded by Ace Qbank software. Ace Qbank technology is in breach of this Agreement through concurrent use of those applications (hereinafter referred to as “dubious applications”) and software. Ace Qbank reserves the right to decide which applications are marked as’ dubious applications.’ When a process or programme is found on a user’s computer to be operational, a system name will be provided to the administrator. In every attempt, the user will also be informed of instructions for deactivation.
However, if such “suspect software” is found running in the user’s computer system, Ace Qbank reserves the right to prevent the start of any test(s). When the Ace Qbank program is running, the user can not toggle between applications. This impaired function is also known and accepted as part of the terms of subscription.
The content presented in the self-assessment examination serves as an educational tool only for medical students and graduates. The Assessment Score is calculated by Ace Qbank based on its own proprietary algorithm. This is not meant to predict your actual MCCQE 1 performance but is designed to help you to assess relative strengths and weaknesses in various medical subjects and systems.
Ace Qbank always keeps your account and performance review data private and without your permission will not supply this information to third parties. If an educational institution (i.e., a hospital or residential school) pays for the services, the written consent enables the educational institution to request Ace Qbank’s performance results.
The Ace Qbank Clinical decision making (CDM) software accurately reflects the official CDM part of MCCQE 1. It should, however, be noted that we have no formal MCCQE-1 exam affiliation. Consequently, we cannot guarantee that the scenarios and software for the case of the Ace Qbank are the same as for the official MCCQE 1 examination in terms of testing operations.
The Ace Qbank software has been tested with a wide range of computer configurations; however, due to the rapidly evolving computer industry and unpredictability of various factors affecting computer systems, Ace Qbank does not guarantee the functionality of its software on every configuration, nor does Ace Qbank guarantee predictable behavior of the software in general. You recognize all of the above terms and accept that the use of the Ace Qbank software on your system is done solely at your own risk.
International Sales Export Restrictions:
According to existing U.S. export restrictions, individuals around the world can access Ace Qbank technology except those in the following countries: Cuba, Iran, Syria, North Korea, and Sudan. You may not buy a subscription or install Ace Qbank technology if you live in one of these countries.
Access to the content of courses:
You may use the approved materials for the particular course(s) and material(s) you have subscribed to. Each course has its own fees for subscription and duration of the course. The content of courses that you did not subscribe to cannot be accessed (e.g., subscription to MCCQE1 Qbank does not guarantee access to other materials such as MCCQE1 Qbank, CDM, and Self-assessment).
Purchase order:
The bulk of the registration information obtained will be used for the processing of orders. You have to provide your credit card number, expiry date, CVV2, payee name, and billing address during the order process. During the order, your card will be charged financial information. This information is used for billing and ordering purposes.
We shall share your personal and financial information with the commercial bank to obtain authorization and authorization in order to process your credit/debit card details properly. An enhanced security system protects this operation. Your personal and financial data is not supplied by us to a third party except as given in the privacy policy of Ace Qbank.
The card processor will check the available funds if you attempt a transaction on our website by making a charge or payable on the amount of your card. The card manufacturer then confirms the correctness of your other data before processing your transaction (for example, your address, CVV2 Code, expiry date, etc.). The payment is denied if you enter an incorrect address or other relevant information. This is NOT a unique situation on this website, but it is how almost all online purchases are made. The card issuing a bank takes typically two to five days to clear out any charges associated with failure/rejection.

Reimbursements:
Unless otherwise mentioned in this Agreement or at the sole discretion of Ace Qbank, no refunds, cancellations, or changes to subscriptions shall be allowed. Ace Qbank shall refuse a refund if the consumer is found to be or is behaving against the interests of Ace Qbank in violation of the Terms and Conditions.
Member Account/Password and Security:
In order to sign up for and use the services, you must complete the registration process by supplying us with the existing information, complete and accurate, as requested in the corresponding registration form. You have a responsibility for the accuracy of the information presented, and you can now update the profiling data to represent the most accurate information. You can also choose from a password. You are entirely responsible for maintaining the privacy of your username and account and all activity on your account. You consent to notify Ace Qbank immediately of any unauthorized use or other misuses of your account. Ace Qbank will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Ace Qbank or another party due to someone else using your account or password.
Ownership:
Licensed materials, including all intellectual property rights within licensed materials (such as copyright), are the exclusive and exclusive property of Ace Qbank. You are not the owner of the licensed materials but are allowed to use them under the terms and conditions of this agreement when you state that you accept these terms.
Terms and conditions of subscription:
You are authorized to use or access approved course materials unless a downtime maintenance interval has been set. As defined in the respective pages of product descriptions, the contents will be given and may change in order to remain relevant during the subscription period.
Qbank products may vary in a number of questions based on changes in content and updates during the subscription period. Nevertheless, as described in the relevant product description pages, Qbank subscriptions will always have a minimum number of active questions. The subscription period starts immediately after the activation. The subscription(s) cannot temporarily be suspended and subsequently reactivated. The course material must be used within the time limit, and there will be no free extensions in exchange for any unused time.
When the subscription period expires, your access will terminate immediately, unless you have extended the terms and conditions of Ace Qbank. You will rework on the current Qbank test data for a predetermined longer period with a renewal.
As the continuation of the current subscription period, renewals are given, but not later after the expiry of this term. You need to renew the subscription before the expiry date. Only the course enrolled will offer a renewal. In the case of the combined package, and renovation is not permitted for the original combined package but only for individual courses in the package. Your right to use materials licensed and this Agreement also ends at the sole discretion of Ace Qbank if any terms or conditions are not fulfilled. During the subscription period, the Qbank test information will not be reset (deletion of test/performance/ usage information).
Interdictions:
Copying, reverse engineering, or altering any or all of the approved materials is expressly prohibited. No part of the licensed material may be copied on any bulletin boards, blogs, discussion forums, Internet domains, or online chatrooms for resale or other commercial use or offered for sale or reproduced. Many of you do not use any computer, program, or routine to interfere with or attempt to interfere with the site’s proper functioning or any on-site operation. You may not reveal or exchange your password or use your password for any unauthorized reason with any third party.
Restriction of transfers:
You may not sub-license, grant, share, sell, lease, rent, or otherwise pass the right to use the licensed materials. All Ace Qbank accounts are monitored. If Ace Qbank believes in multiple users simultaneously using an account at its sole discretion, Ace Qbank reserves the right to terminate that account without notice or refund. We do retain the right to sue for breach of contract. Therefore, please do not disclose your account details to anyone else.
Violations:
In the event that you breach any term of this agreement, Ace Qbank may, at its sole discretion, terminate this agreement, your access to the site, and its provision of services to you without refund. Ace Qbank reserves the right to seek all remedies available by law and in equity for such breaches.
No Warranties:
Ace Qbank PROVIDES ITS SERVICES “AS IS” AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Ace Qbank does not endorse and is not responsible for the accuracy or reliability of any opinion, advice, or statement made through the site by any party other than Ace Qbank. Other than as required under consumer protection law, under no circumstance will Ace Qbank be liable for any loss or damage caused by your reliance on information obtained through the site. - Ace Qbank will use reasonable efforts to rectify any error that occurs on its site but does not guarantee access to the site in case of software errors/viruses/other natural or technical catastrophes that cannot be repaired in spite of a reasonable effort.
- Ace Qbank will use reasonable efforts to keep its site online at all times. You understand that scheduled maintenance and problems out of the control of Ace Qbank can cause the site to be temporarily unavailable.
Limitation of Liability:
Ace Qbank specifically disclaims any liability (whether based in contract, tort, strict liability, or otherwise) for any indirect, incidental, consequential, or special damages arising out of or in any way connected with access to or use of the site, this agreement, and our services, even if Ace Qbank has been advised of the possibility of such damages, including liability associated with any medical malpractice or viruses, which may infect a user’s computer equipment. The total liability of Ace Qbank arising of or in connexion with your use of its products and website, irrespective of the cause of the case (whether in contract, tort, violation or otherwise), will not exceed your subscription fee.

Law on Governance:
The present Agreement reflects the full understanding between the Parties with regard to the subject matter and hereby expressly substituted and revoked all previous agreements, resolutions, commitments, and undertakings, either oral or written. The present Agreement is governed by the internal substantive laws of the province of Ontario in the CANADA, Unrespecting the concept of conflict of laws.
All disputes resulting from this Agreement shall be subject solely to the jurisdiction of the State or federal courts within Toronto, Ontario, in the CANADA.
In the event that any terms of this Agreement by any court with competent jurisdiction is found to have been null and void, the invalidity of such provision shall not affect the effectiveness and full force of the rest of the provisions of this Agreement. A further or ongoing waiver of this term or term shall not be deemed to waive any term in this agreement.
